After about an hour and a half of deliberation, a York County jury sentenced Harve L. Johnson to death for the murder of two year old Darisabel Baez.

Governor Ed Rendell signed an execution warrant for John Amos Small, who was convicted of first degree murder in 1996 for the rape and murder of a Hanover girl. Small is scheduled to die by lethal injection on December 16.

The Honorable John S. Kennedy has granted Robert King III and Donte Milburn’s request for separate juries although they will be tried together in December. King and Milburn have been charged with the 2006 murder of Juan Miguel Laboy after being indicted by a grand jury last December. King is already serving 27 to 54 years in prison for a prior robbery and third degree murder conviction. All other pretrial motions were denied.

Deshon M. Gibson pleaded guilty to attempted homicide, three counts of aggravated assault, reckless endangerment, illegal possession of a firearm and carrying a firearm without a license for an incident in April when he fired three shots at a Hellam Township police officer. Gibson was sentenced to 10 to 20 years in state prison.

Neida E. Baez pleaded guilty to third degree murder of her 2 year old daughter Darisabel. Baez is now expected to testify for the Commonwealth in their case against Harve L. Johnson. Johnson’s trial is set to begin Monday, November 2 before the Honorable Michael J. Brillhart. If convicted of first degree murder Johnson faces the death penalty.
